By accessing or using ByteSMTP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

ByteSMTP is an email hosting platform that allows you to send and receive email using your own custom domain. We provide mailbox management, DNS configuration tools, spam filtering, and optional AI-powered email features.

3. Plans

Free Tier

• Up to 2 domains and 5 mailboxes
• Full email functionality with DKIM, SPF, and DMARC
• Minimal, non-intrusive advertisements served by Google AdSense
• A small "Sent via ByteSMTP" footer may be appended to outgoing messages

Pro Plan ($4.99/month per mailbox)

• Unlimited domains and mailboxes
• No advertisements
• No email footer branding
• AI Email API access
• Priority support

4. Acceptable Use

You agree NOT to use the Service to:

• Send unsolicited bulk email (spam)
• Distribute malware, phishing, or fraudulent content
• Send or store illegal content under applicable law
• Harass, threaten, or abuse others
• Impersonate another person or entity
• Exceed reasonable usage limits or attempt to overload the system
• Circumvent security measures or attempt unauthorized access

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration. You are responsible for all activity that occurs under your account.

6. Account Termination

We may suspend or terminate your account at our discretion if you violate these terms. You may delete your account at any time through the dashboard. Upon termination, your data will be deleted within 30 days.

7. Ad Insertion (Free Tier)

Free-tier accounts may have minimal, non-intrusive advertisements displayed in the web interface and a small branding footer in outgoing emails. Upgrading to Pro removes all advertisements and branding.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTESMTP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service. The Service is provided on a best-effort basis. We may perform maintenance that temporarily affects availability and will endeavor to provide advance notice when possible.

10. Intellectual Property

You retain ownership of all content you send, receive, and store through the Service. We claim no intellectual property rights over your email content.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to registered users via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first.
